Article 29A gives the right to construct certain

piers.

Article 30 is now. The road to Deep Water Bay

from Aberdeen is now being constructed with a

clear width, apart from side drains and walls

where necessary, of 16 feet and it is probable

that before long it will be desirable to continue

it to Stanley and Tytam. In view of the exclu-

sive rights of transport granted to the promoters

it was considered equitable to provide that they

should contribute to the cost of widening and

constructing where necessary that portion of the

road which ran through their concession. $30,000

is approximately half the estimated cost of

widening the portion of the road from I to J and

to L and constructing a new road from ♬ to F.

(k). Articles 31 and 32 are new. Article 31 provides

for possible development. Article 32 protects

the Promoters from competition within the area

which is the subject of the agreement.

(1). Article 33 has been inserted in accordance with

the suggestion made in paragraph 2 of your des-

patch under reference.

(m). Articles 35 and 36 are formal.

I enclose a copy of the resolution passed by the

Legislative Council and you will observe that it concludes with

the words "on condition that the promoters furnish to the

"Government satisfactory proof of their financial ability to

"carry out the scheme". The promoters have not yet furnished

such proof. As far as I can learn it is not likely that they

will find the necessary financial support in the Colony. It is

probably their intention to endeavour to find it in London. It
